1. Acceptance of Terms

By accessing or using MyDocksidePro (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and AIM Consulting LLC (“Company,” “we,” “us,” or “our”), the entity operating MyDocksidePro.

We may update these Terms from time to time. We will notify you of material changes by email or through a notice in the Service. Continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

2. Description of Service

MyDocksidePro is a web-based field service management platform built for marine service businesses. The Service enables you to log jobs, manage customers and vessels, create and send invoices, track team members, sync with QuickBooks Online, and accept payments — all from any web browser.

The Service is accessed exclusively via web browser at app.mydocksidepro.com. No native mobile or desktop application is required.

3. User Accounts and Registration

To use the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You must be at least 18 years of age and have the legal authority to enter into these Terms on behalf of yourself or the business you represent. Each account corresponds to one business entity identified by a unique Business ID.

You may invite team members (employees and contractors) to your account. You are responsible for ensuring that all users of your account comply with these Terms.

4. Subscription Plans and Billing

The Service is offered on the following plans:

Lite — Free. Up to 10 invoices per month. Additional invoices available at $9.99 per 10.
Solo — $59 per month. 1 user. Unlimited jobs and invoices.
Team — $129 per month. Owner plus up to 5 crew members.
Team XL — $249 per month. Unlimited crew members.

Paid plans include a 14-day free trial for new subscribers. No credit card is required to start the Lite plan. Billing is monthly and renews automatically unless cancelled.

All prices are in US dollars. Taxes may apply depending on your location. We reserve the right to change pricing with 30 days' advance notice to subscribers. Price changes will not apply to your current billing period.

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds are issued for unused portions of a subscription period.

5. Payment Processing

Payments for subscriptions are processed by Stripe, Inc. By subscribing to a paid plan, you agree to Stripe's terms of service and authorize us to charge your payment method on a recurring basis.

The Service also enables you to collect payments from your own customers via Stripe Connect. By connecting your Stripe account, you agree to the Stripe Connected Account Agreement. A platform fee of 1% applies to payments collected through Stripe Connect. You are responsible for your own tax obligations related to payments received from customers.

6. Data Ownership

You retain full ownership of all data you enter into the Service, including customer information, vessel records, job records, and invoices (“Your Data”). We do not claim any ownership rights over Your Data.

By using the Service, you grant us a limited license to process, store, and transmit Your Data solely to provide and improve the Service. We will not sell, rent, or share Your Data with third parties except as described in our Privacy Policy or as required by law.

You are responsible for ensuring that you have all necessary rights, consents, and permissions to enter your customers' data into the Service.

7. Acceptable Use

You agree not to use the Service to:

Violate any applicable law or regulation.
Infringe the intellectual property rights of any third party.
Transmit spam, unsolicited messages, or fraudulent communications.
Attempt to gain unauthorized access to the Service or its underlying systems.
Reverse engineer, decompile, or disassemble any part of the Service.
Upload or transmit malicious code, viruses, or other harmful software.
Use the Service in a manner that disrupts or overburdens our infrastructure.
Resell or sublicense the Service without our express written permission.

We reserve the right to suspend or terminate your account immediately if we determine, in our sole discretion, that you have violated this section.

8. Intellectual Property

The Service, including all software, designs, logos, text, and other content we create, is owned by AIM Consulting LLC and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

9. Termination

You may terminate your account at any time by contacting us at support@mydocksidepro.com or through the account settings in the Service. Termination does not entitle you to a refund of prepaid subscription fees.

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including but not limited to: violation of these Terms, non-payment of fees, fraudulent activity, or prolonged inactivity. Upon termination, your right to use the Service ceases immediately.

We will make Your Data available for export for 30 days following termination of your account. After that period, we may delete Your Data from our systems.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

We are not responsible for the accuracy of any data you enter into the Service, nor for any decisions you make based on information provided by the Service.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AIM CONSULTING LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR SERVICE INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

12. Indemnification

You agree to indemnify, defend, and hold harmless AIM Consulting LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Florida, and you consent to personal jurisdiction in those courts.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AIM Consulting LLC regarding the Service and supersede all prior agreements and understandings.
